My mother is no more & i am divorcee. I had been thrown out of home & intentionally kept out of proprty matters after my mother's death. My father has already transferred his property(gain by his income) to my brother's name.My mother has her maternal ancestral property. my grandfather(mummy's side) is no more . I want share in my mother's ancestal property. My father alone can give them in written (without knowing me) no claim letter? my father told my maternal uncles that he is not interested in property? Can he do like this without knowing us? i want my share in my mother's property. For my mother's property who will the claimant? My brother & father will get share in my mother's property?

yes, your mother's share would be equally divided amongst your father, brother and you. you can file a suit for partition and possession and also seek a stay from the court concerned.
