occupation of property against dowry

My brother in law (sisters husband) forcibly occupied the part of the agriculutural land belonging to my mother. The boundary stones fixed by the revenue authorities are disturbed. My brother in law is telling that he occupied the land against the dowry. The incident took place 4 months back. At present he is threatning to occupy the full land. The land is purchased by mother on her own. police were informed and they have not registered any case. is it possible to send the complaint to police by registered post ?. or is it better to approach the court ?. Kindly advise. Thanks in advance

You may sent complaint through registered post but it is better to approach the court.

Pressuming that you have the certified copy of the land extract and map from the Land Revenue Authorities. If not please get them urgently. Appoint some good advocate in your village, than have to register a written complaint to the Land Revenue Authorities and cc to the police that your brother in law is trying to encroach on your mother's property and do not mention the fact that he has encroached. Than spend some money and erect a urgent boundary fence around your mothers property. Take photographs of the same and file a suit against your brother in law for permenant injunction restraining him from encroaching your mother's property.

You can send complaint to local police as also superior officers by post.

However, criminal complaint or approaching criminal court may not give you relief. Criminal proceedings are meant to punish the offender.

For removal of encroachment, you need to approach civil courts.
