Plot Registration

I have paid 6.5 lakhs in 2006 november to a real estate company for a plot which was owned by two partners. The partnership broke in nov 2007 and now the company is owned by partner A. plot was not registered for me. partner A says B should pay my money back since the legal agreement for the plot was signed by partner B. and partner B says he already left the company so he is not liable. In this position against whom I should raise the case. I want a compensation of around 10 lakhs for all the frustation and pain both have given me. Please suggest what should I do.

You may consider filing case against the firm as also both its partners and let court decide who is liable to pay.

Since at the time of payment both were partners, you should institute legal proceedings against both irrespective of dissolution of their partnership.

The company will be liable to pay your dues and damages. i hope you have all the documents with you. the first step will be to send a legal notice to the company as well as the two partners.

A proper strategy can be formed after inspecting the documents.
