Legal Question in Real Estate Law in India

I purchased flat in Hyderabad, and paid 50% of cost. flat supposed to handover by mid 2012 and its not been delivered.They are sold me land owner flat and saying flat not getting released by land owners so forcing to change flat and asking for huge money which is current rate.
While dealing with me for flat did not provide information about land owner flat.
My question here.
1. How they sold me Land owners flat without confirmation with land owners.
2. it should be builder responsibility to change flat on same cost( deal price)
3. If builder deny to give same flat , what should i do
4. is consumer court will be helpful in this scenario.

Under Law,the purchaser should do the 'due diligence' before buying the property. You can approach consumer forum
