Legal Question in Real Estate Law in India

I purchased a property in 2006 and since I was out of station had given the GPA to my father to register the property on my behalf. I wanted to sell the same and was informed that the GPA copy is a requirement for bank loans. However, the GPA was not traceable and the broker suggested that my father would be required to be present at the time of registration and his picture, signature would be captured in the sale deed as a consenting witness. Once the sale deed has been executed in the above manner will there be further requirement of a GPA by bank, since the original sale deed that I purchased and the sale deed that we now make will have the picture of my father as well as his approval?

The authorities may require original GPA at the time of registering sale deed.

GPA copy is always required for the Bank loans and when you sell it you are supposed to give the purchaser copy of the GPA for their purpose since it is part of parent documents. For this purpose you can apply a certified copy of GPA and give it to the purchaser and the same will solve all purposes. For any further advice contact me at [email protected]
