Rental house

We are a tenant in Mumbai for the last 40 years and the rent is paid by my father and how he is old now I want to change the tenancy to my name and pay the rent.

You are required to pay the rent irrespective in what name the tenancy exists. In case of death (Allah may forbid), same tenancy agreement will remain continue being successor-in-interest. If problem arises, new agreement may be signed.

Transfer of tenancy is not permissible. However, you can pay rent for and in the name of your father.

You may continue paying rent. Tenancy may not be changed during life time of the original tenant i.e. your father.
