Legal Question in Real Estate Law in India

Stamp Duty on Rectification Deed

Sir, in the rectification deed, the extent, location and parties to the document have not changing, but the Plot No and all side boundaries have changed. The said alteration occured due to the reallotment of plot nos in the layout plan, by the local authority. The registration authorities are demanding full stamp duty as if a sale deed. Please advice me and quote some citations of the Courts in this regard. I will be very greatful.

Re: Stamp Duty on Rectification Deed

If physical location of plot and area is unaffected, no reason to charge any stamp duty, except for the Rectification or Correction Deed.

In these circumstances, appropriate to apply to the Collector of Stamps for adjudication and after adjudication register the document.
