Legal Question in Wills and Trusts in India

My father has a brother.my uncle says that my grandpa has made a will in 2000. my grandpa died in 2000. but we r not aware of the will though grandpa was with us for more than 20 years.my father transfered a flat on his name according to nomination done by grandpa. my uncle says that the signeture on the nomination form are fake and he filed a criminal case against my father sec-420,461. my father died on february 2009. we tried to check whether the will is probated or not? and it is not. now the society is not transfering the flat on my mothers name. we have the share certificate. what can we do to transfer the flat?

get the succession certificate from court and file a declaration suit to transfer the flat in your mother and your name.
