if a mother dies without leaving a will then how do we go about transffering her property to the legal heir

You may apply to court for succession certificate; whch will enable you to get the property transferred to the d eceased person's heir(s).

in that situation, if the property is joint family, the same would continue to be the same and a partition suit is to be filed to get the same partitioned by metes and bounds but as you saying that no will was left, it may be presumed that it is a self acquired property and in that situation, you may follow Mr. Shroff s advice.
