I am in Indiana and own a construction company which is a LLC I would like to protect a "also doing business as" name under my current LLC. Can I just add the name or should I form a new LLC under my existing one?

In order to reserve and use an assumed business name, such as ABC Company, LLC d/b/a The Construction Company, you must simply complete and file Form 30353 (Certificate of Assumed Business Name) with the Indiana Secretary of State. This can actually be done through their website now. No new company needs to be formed and you can begin advertising your company under the assumed business name. Of course, the same rules prohibiting you from forming a limited liability company using a name already in use or which would likely confuse the public as to which company he or she is dealing with apply here. A call to the Indiana Secretary of State's Business Services Division can determine whether a desired assumed business name is available.
