Legal Question in DUI Law in Indiana

Could I be found quilty for this?

A friend and I were coming back from Atlanta with my 5 year old son when we pulled into a gas station in Columbus Indiana. My friend was driving and he was not drinking. I purchased a 6 pack of beer back in Kentuky. My friend stopped to use the restroom and I jumped into the driver seat incase we needed to move the truck (which I did not). About 5-10 min. later a police officer parked behind me. He came towards me and saw an open beer bottle. To make a long story short. I was arrested for a DUI, but I was never pulled over or seen driving the vehicle. Can I still be found quilty of this? I was put in the county jail for 2 days because I refused to pay $750 for bail. Help me please.

Hello! Clearly the officer

rushed to judgment and had

no probable cause to arrest

you. A good Indiana lawyer

should be able to defend you

and get the charges thrown

out. But.... you definitely

need representation. I hope
