Legal Question in Family Law in Indiana

My child was admitted into acute mental hospitalization. His father visited him during his normal visitation hours how ever missed his full weekend visitation. He is now asking for make up time for the time that our son was hospitalized. I tried to offer to let him have the following weekend and restart visitation schedule. He refused and demanded for 2 weekends in a row. I believe since neither one of us were in care of our son at the time of his hospitalization that we should resume visiting schedule as normal. He is now seeking contempt of court charges. Do you think this will hold up in court? Because there are no rules regarding these circumstances. Please advise on our situation. Thank you.

Without knowing protocal and practice in the court where the petition will be heard, I cannot answer this. However, what is the big deal if your son has an extra weekend with his father even if you are correct? If you two are following the guideline visitation schedule, you have your son almost three times as often as his father. Losing two nights and parts of three days may not seem like a major loss to you, but in reality it may be to the father.
