court delays

I brought action against my Ex for contempt anad custody based on her noncompliance with our divorce agreement on several issues and her placing our child in harmful environments. The court date was originally scheduled for 9/06, postponed by the judge until 11/06, postponed again until 1/07, and now the judge has demanded arbitration prior to hearing the case. I have exhausted my savings with attorney fees over the past year and have continued to uphold my end of the divorce agreement but have received no satisfaction from the court on my case. The hearings were postponed, according to my attorney, because the judge is in collusion with my Ex's attorney (also a State Representative) to force me to drop the case. I have contacted the Indiana Bar Assoc. and received no response from them. I feel as a non-custodial father that I have no civil rights in regard to my child and property.

What course of action do I have to receive a fair and speedy hearing? Is there anyone to contact to investigate the claims of collusion?

Those are very serious accusations and I am surprised an attorney would tell you that, unless he or she has proof. I suggest that you look at the court file to confirm the reasons for the new dates and obtain the proof that your attorney has concerning collusion. You need to contact the Indiana Supreme Court if you feel that there has been judicial and/or attorney misconduct, not the Indiana Bar Association. Again, I caution you about unsubstantiated allegations.
