Am i eligible for divorce?

I am staying in the usa for past 9 months on a dependent visa status provided by my husband . i want to file for a divorce am i eligible ? i am also financialy dependent on him.

i have currently left the house as he was mistreating me . what are my choices? if i file for a divorce can the court get him to pay for a atorney too? i am not eligible to work on this status ...till i am is he entitled to provide me with support? can he revoke my visa status ? am i eligible for alimony? what are my choices provided by the USA government?

Whether your are subject to the jurisdiction of the courts here will depend on if you are considered a resident on the state and county in which you seek a divorce. This means that you have been a continuious resident of the state of Indiana for six months prior to filing and the county for at least three months. You may ask the court that it award you any attorney fees you've spent, but the court will look to the circumstances regarding your financial situation to determine that. Alimony does not exist in the state of Indiana, but maintenance does. The court may award it on temporary basis after considering the financial situation, which could under the right circumstances become permenant. It will all depend on the facts of the case. If need be, a protective order may also be requested if you are in fear of being harmed. If you're divorcing an American citizen, then your status could be impacted, but that would not be in the jurisdiction of the divorce court.
