guradianship

I have got guradianship of my half brother his father is in jail. I was wondering if his father get out can he just take him? Or does he have to take me to court? His father is in there for a sexually crime to a minor and and drinking.

If the legal guardianshipship exisits and is here in the state of Indiana,that will remain in full force until either the child reachs the age of majority, his/her legal status changes or the court rules otherwise. If the father wants the child back in his care and control, then your legal status as the the guardian must change. He would need to do this by filing the appropriate petition with the court seeking such a result. You could agree to it, and if not the court would hold a hearing to determine the result.
