Legal Question in Family Law in Indiana

Legal Fees

We are in process of forcing a relative to drop guardianship (probate court) of his mother for misuse of her funds. We were nor informed by his lawyer that she needed a guardian. He stated he did not know where we live even though he had been to our house. He did not want us involved because we know what type of person he is. We would have challenged it. We have accumulated fees of over $2,000.00. Is there any way that we can recoup these fees? Can a lien be put on his property and how do you go about it? Garnishment? Any info would be greatly appreciated.

Re: Legal Fees

If you hired an attorney to assist you in challenging the guardianship, then he would be asking for fees for you at the hearing. If you are successful, then the fees can probably be charged against the estate of the ward. If you are not successful, then your fees are your own responsibility. The judge will make a determination whether the "former" guardian is responsible for the fees or whether the estate is.
