Legal Question in Family Law in Indiana

pregnancy and divorce

I have been seperated from my husband for one year. I want to divorce him. But I am pregnant. Not by him. I think in the State of Indiana a judge will not divorce two people if the female is pregnant. This is not his child and I do want to divorce him.

Re: pregnancy and divorce

Although you didn't actually ask a question, I'm going to assume you did:

You are correct. Until you have the baby, no court will grant your divorce. You can file the petition now, but your case won't be finalized until after the baby is born, regardless of whether the baby is your husband's or someone else's.

Hope this addresses your concern.
