Legal Question in Family Law in Indiana

My wife & I just got married in Indiana. She has a 4 yr old daughter & will be moving her 40 miles away from her ex husband. What is the possible punishment if she moves before her 90 day required notice is up?

The reality is that many people need to move with less than 90 days notice. As long as as much notice as possible has been given, I have not seen a court "punish" the moving party.

If the father objects to the current custody arrangement under the move (He cannot object to the move, only how it would change the custody arrangement) he could request that the custody order be modified, to make the mother more responsible for transportation, etc.
