Legal Question in Medical Leave in Indiana

need an answer for the family medical leave act

My Mother who is Deaf is hospitalized and I am needed there to interpret for her. Would this be covered under the Family Medical Leave Act? My employer has denied my request so I will end up loosing my job.My Step-Father is also deaf so that is why I am needed to stay at the hospital with my Mother.

Re: need an answer for the family medical leave act

The FMLA allows leave to be taken to "care" for a parent. It appears that your employer is taking the position that your mother's need for an interpreter does not qualify. However, I believe that there is an argument that your interpretive assistance is needed to care for your mother and thus your situation is protected by the FMLA.
