Is an employer obligated to offer the FMLA to an employee that they know is disabled?

Knowledge of a "disability" does not really change the equation. As long as you have been employed for at least a year, worked 1,250 hours in the last 12 months, your employer has 50 or more qualifying employees, you have a serious medical condition that requires you to miss work, and have not used up your 12 week allotment, your employer is required to grant FMLA leave with proper medical certification.
