Legal Question in Immigration Law in Indiana

working wihout authorization

spouse of a J1 visa holder worked oddjob without authorization due to financial hardship about 4/5 years back for a brief period of time. Now they going to apply for change of status to H1, H4. They never been out of status, and J1(main applicant) never worked without authorization. How does it effect when they apply for 'change of status'? Is there any fine or penalty for spouse working? Does the spouse need to go back to home country?

1st thing that needs to be done is to get the waiver. Do they need asistance in that?
