Legal Question in Insurance Law in Indiana

Insurance Policy Lapse

I own a printing company which employees 10 people. Our company's insurance lapsed as a result of bookkeeping error on my insurance company's part. If I have copies of my canceled check and have proof that I was current on my insurance, can I sue them for damages to my company? An employee called me yesterday to tell me that his prescription card was rejected because his insurance had lapsed. Since our employee's pay a portion of their insurance, needless to say he was very upset. This was very embarrassing to him and even more embarrassing to myself. When I arrived at work this morning I was confronted by other employees, asking why their insurance had lapsed. I've had it with insurance companies taking constant advantage of people. If I could sue them for damages, you bet I would. If I can't I guess I'll just move on. Please let me know what rights I have. Thanks in advance for any responses.

Re: Insurance Policy Lapse

You have an action for breach of contract against the insurance company. You may also have a bad faith claim against them for refusing to honor any claim.
