Legal Question in Landlord & Tenant Law in Indiana

I am not sure where this would fall under so I put it under Landlord & Tenants

I have a nephew and his wife that came to live with me. I am disabled and in a wheelchair and they needed a place to stay and he run errands for me and does things around the house. She walked out on March 11 and he filed for divorce on 4/5/2011. She still has her things at my house and I want them out of my house. If I have to give a 30 days eviction notice can I start from the day she left or do I have to start on 4/5/2011?

I would wait until the divorce is over as the court may consider those things to be marital property and therefore also owned by your nephew. The nephew's attorney should be able to have a clause regarding picking up whatever is determined to be her items by a date certain in the divorce decree.
