Legal Question in Wills and Trusts in Indiana

Death of brother

My brother, who was an adult, died almost 3 years ago in a car accident. He had no children and was never married. Although he lived with his girlfriend, he still sometimes resided with our parents and he also received his mail there. He had no will (he was only in his early 20's). Although it was suggested that a trust be set up for his 2 young nieces, they (parents) kept everything for themselves. My brother and I, and my other brother were so very close that it hurts and angers us that our parents gave nothing to us. Some money could have been put in a trust for the little ones and some of his stuff, toys from when we were little, guns that we collected and fired together, cars, 4 wheelers, etc. Anything would have been better than nothing. My parents think they are the only ones who lost him. Do they have a right to all of his belongings just because he still lived with them? Any suggestions? Thanks so much.

Re: Death of brother

I recall the time for opening an estate is two years. That may leave nothing practical that can be done. I suggest contacting a local probate lawyer.
