Legal Question in Wills and Trusts in Indiana

estate law

My mother died in the state of Indiana and left asome farm land next to a subdivision. My sister is exector and tells me the estate has to be sold as a whole, cannot be divided. There is a new subdivision of 12 acres of land adjacent to my mother's estate which she previously owned. There are 28 acres of farm land in the estate right next to it and a farm house on the front of the property, which has been remodeled. Can't we sell the house separately from the acreage?

You really need to talk to an attorney. There is no way to effectively answer your questions via e-mail.

This is a real estate matter, and since land is "unique" the only person who can help you wade through it is a local lawyer who can look at the property, deeds and title to determine severability and what your options are.

Further, if the disposition of the property is entirely legally your sister's responsibility, then you ought to try to mediate the result, so that everyone else is on board with the decisions she makes.
