Legal Question in Wills and Trusts in Indiana

Living Trust

My aunt is the creator and of my grandmothers living trust. She also had Power of Attorney. My grandmother passed away in October and my mother passed away in June. My sister and I don't believe the living trust was changed, removing my mothers name. We have subtly asked my aunt, and she says it has been changed. I asked my uncle if he had received a copy and my aunt still won't let anybody see the details in the living trust. So basically, known of us know who the beneficiaries are. I have seen the original trust which had my mother, aunt and uncle as beneficiaries. What is the next step we should take to make her show us the living trust?

Re: Living Trust

If your grandmother was a resident of Indiana when she died, then a probate estate should be opened in Indiana. Then your aunt can be hauled into probate court to account for your mother's share of your grandmother's estate. As a successor to your mother's interest, you have a right to be informed about the trust and its administration. If you do not know an attorney you trust, then contact the county bar association where your grandmother lived, and ask for a referral to an experienced probate attorney.

Good luck.
