What happens if a property was never turned into probate after the death of the parent/owner? Are there penalties in Indiana even if the family was in agreement about someone continuing to live in the residence, but one person has decided she wants her share after 19 months?

Penalties? Not really. The heirs and beneficiaries might have a thing to say and litigate about. Indiana's Department of Revenue might have penalties but I do not think they are the sort that you are thinking about. If an estate was opened, there ought to be an attorney for the estate. The personal administrator needs to talk to counsel. If not estate was opened, I would say that you had better get one opened as this may turn into a mess.
