Legal Question in Civil Rights Law in Iowa

removing friend from my apartment

My daughter had a boyfriend move in with her 6 months ago.the apartment was her's, she pays all rent and utilities as he has been unemployed the whole time.She now wants him to move out, she removed his things and changed the locks. was then told by the town police that she had to let him back in and that what she done was illegal. how does she get him removed,the town and county police are telling her what she cannot do but not what she can do.he has not been physically abusive yet.she does not have alot of money for a lawyer since she has to pay all the bills. it seems like he has more rights in this situation than she does, she is having to live with someone she wants out of her apartment, that she doesn't feel safe with,that she worries that he will destroy all the things she has worked for, while he has it made by knowing that he can keep living there getting free room, and whatever he takes,while she is at work trying to pay the rent . while she can't seem to do anything about it. any help yopu can give will be greatly appriciated. thank you for your time,--name removed--ruhlow

I can't imagine that he has any right to live there. He is a guest nothing more. However, if the police insist that he be let back in there, it's time to go to court and get it sorted out. They can't force her to take the man back in, especially if his name is not on the lease. If it is, however, then she's got a problem, because he has a right to live there even if he doesn't pay the rent, until a judge says differently. Of course, she could always move to another apartment without him and save on attorney fees and a whole lot of hassle!
