Legal Question in Civil Rights Law in Kansas

my house got damaged in a windstorm. I asked my ex nephew to put a new roof on. my stupidity I never set a price we just agreed that I would buy the materials and he would put on the roof. His boss that owns a roofing comapany said he would look over what the insurance company would pay as he had been an adjuster at one time, and make sure they was not low balling me. I bought the shingles online that night and arranged for them to pick them up. I gave lee my nephews boss a check for 800 to use his dump truck, the dump fee, nails, felt plus other supplies. He gave me a receipt for 2400 written out paid in full. When my nephew came to do the roof he prought another guy with him he said he needed help tearing off the roof. they then brought in another guy to help picking up the ground. I gave brandon my nephew 600.00 for the two guys that came to help. then lee gives me a receipt for 3076.00 written on it paid in full that was for the decking that they said they had to put on plus fixing sub decking broards. Brandon told me to never mind paying him that he could wait this was not infront of anyone but me. they worked on my house for 4 days then I received another bill from his boss lee for 1076.00 stating that I owed him for material and labor for the decking. he also told me my insurance company had not given me the right amount and didnt quote the right price so he gave me a bid. They left for a few days then came back and made my roof water tight ( felt and flashings put on) and my nephew said that he would be back in two days to start shingling. in the mean time my mortgage company will not leave me alone about a contractor working on the house and I need to send lein wavers, tax numbers and Lee was happy to give them to me and I made sure they where all notorized. I sent them to my mortgage company. well two days later brandon fell off a roof injuring himself where he cannot work on my roof. this was the weekend before Christmas lee said he would bring out a foreman and another guy but that was going to cost me another 800 plus a guy to help him another 500. Then Lee said that it was too cold to lay the shingles. as of today january 27th I still do not have shingles. But I did get a call from my nephew stating I needed to pay the bill of 1076 plus he needed money for his labor that he worked hard on the roof. If I did not pay them or make some sort of payment arrangements they was going to garnish my wages and put a lien on my house. I was to call my nephew yesday on what my decission is money or tie up my assests. That they have talked to my mortgage company and my insurance comapny and that the mortgage and insurance company told them that they sent checks out to me plus other checks.Brandon also stated that he has pictures of them working on the roof and that is all the proof he needs. I am at a loss to what to do. My kids say not to pay the bill of 1076.00, as they noticed that it was dated December 15, 2002 and since my roof wasnt damaged then the bill is nulled and voided. and since brandon hasnt finished his end that I should nt pay him for his labor that he done. I told them I should pay the bill of 1076.00 and give brandon 600.00 for his labor and have someone else come out and finish the job. I really do not know what legally I should do. I do know I need my roof done and I do not want them touching it anymore because I do not know how much money I will have to pay. HELP

Hopefully your house is fixed by now. If not, then you need to hire counsel to address this situation for you. Both you and the contractor have tried to defraud the insurance and mortgage companies. Sthe insurer paid, and someon might go to jail or lose their contractor's license.

Good luck
