Legal Question in Family Law in Kansas

My boyfriends ex wife and him just recently went to court to modify custody since she had met some one online and wanted to move 5 hours away. We went to trial and after an extensive trial they let the childs decision factor in which is with his mother. We have every other weekend and extensive summer time and shared holidays. We just found out that this man she was engaged to for a year and lived with since June is now no longer and she just let us know today she has found her own house. We know she isn't working at this time and that is the main reason she moved up there was to start a life with this man. We haven't spoken with our attorney yet, this would be a material change of circumstances correct? She is already unstable with her new life. The child has live in Chanute his whole life expect 6/15-present. We are both employed and stable. I am just trying to see if its worth taking her back to court immediately or document things until school is out in may. She has been late for drop offs several times in the last few months with only an hour of letting him know she would be and its a 2 1/2 hour drive there and back total of 5 hrs. What can we do? Thanks so much!

You have no grounds to do anything. The boyfriend might be able to seek a new modification, or have the Judge/commissioner reconsider their ruling. Have him trek the attorney about this development ASAP, s waiting might mean he acquiesced to the new conditions.
