Legal Question in Family Law in Kansas

My ex (never married) wants to relinquish his rights over .. But I'm currently not married.(I'm in a relationship and he's willing to adopt my son but we're not married) if the state of Kansas won't allow him to sign over his rights so my boyfriend can adopt him(I heard because we're not married if my ex signs his rights over to my boyfriend it will also remove mine?) , can he just relinquish his rights to me??

The father can relinquish his right to visitation and to participate in making decisions, but not his obligation to provide support. You're correct, your efforts to try for a unilateral relinquishment by the father, might cause the state to take custody if the child from you. Your boyfriend can Petition to adopt the child. Without you two being married, success might be difficult. You and he need to consult directly with a family or probate law attorney, in your area.

Good luck
