Is it better to file married joint or married separate if my husband moved out in September but we are not legally divorced?

Nornally, a married couple will save money by filing a joint return. From a legal standpoint there are several factors to consider:

1) Do you know where your spouse is?

2) Will you be able to share information well enough to file a joint return?

3) Can you agree on how to pay any liability or share any refunds?

If any of these factors are questionable, you may be forced to file a separate return. Also consult an experienced tax planning professional.
