I need to know when someone is in control of the will, do they have to reside in the same state? my brother has the control of our dads will which is in kansas, but he lives in calif. so is he in the right?

Lawyers do not know what you mean when you say someone is in control of the will. If your brother has the original will and your father resided in Kansas and he has property that requires probate in Kansas, then the probate of that property would be done in a Kansas court. The executor nominated in the will and if that is your brother would have to apply to a Kansas court to be appointed so he could administer the estate that was in Kansas.
