Legal Question in Bankruptcy in Kentucky

my ex-spouse filled bankruptcy chapter13

My ex spouse filled chapter 13. We have a joint mortgage and he was court ordered to make the payment until he bought me out or the property was sold. He let it go into foreclosure and filed chapter 13. Will the mortgage company come after me? Also I am remarried. Can this affect my husband. The property the foreclosure is on is in Kentucky. I now reside in WVA. any advice would greatly help me. Thanks in advance!

The Bankruptcy Code provides for relief to a spouse who is to be protected from joint debts in a divorce decree. It does require appearance and probably an adversary proceeding in bankruptcy court. Enforcement of your rights to be protected must be asserted. As with all rights, they can be lost through the passage of time. Bankruptcy court has many short limitations. You must consult a bankruptcy lawyer.
