Do I need an attorney?

Four years ago I resigned from my job at a company and moved to another company in a nearby city. In the last 12 months an audit conducted by the State Auditor's Office has found that the company president may have misused company money. The president of the company is now the focus of a criminal investigation by the State Attorney General's Office. The investigation is looking into activity by the president covering a 10 year span (including the five years I was employed by the company). Since the investigation was launched 5 of the 6 directors for the company have resigned.

I received a call from both a private investigator working for the defense attorney and an investigator with the State Attorney General's office asking for some clarification or my recollections from my time with the company.

I was a department director at the company but was not involved in any of the activities being investigated. I would like to know if I need to consult an attorney.

When investigators are reviewing company records for a substantial period of time, including years in which you played an important role, then yes I think you need an attorney. You do not know what the other employees and insiders are saying about what happened -- they could conceivably be trying to make you the scapegoat.

With something as important as your reputation and potentially your future freedom from incarceration, I would not take any chance that I did not have to. And going without an attorney now is taking a chance.

Of course, I am biased, but I still believe I am correct.
