It is not possible to give you a clear legal answer to your inquiry without a more detailed evaluation of the facts of your case. Several questions are presented:

1. Did you give an oral or written confession to the police? If not, their failure to give you a "Miranda" warning is immaterial.

2. A male police officer is allowed to perform a pat-down search of a female suspect.

How can you and your girlfriend "beat" the charges in court? That depends upon a number of factors, including the circumstances surrounding your arrest (were you at home, or in a public place?), the amount of alcohol you had consumed (were you "obviously intoxicated?"), and what you said to the investigating officers.

You should not take any action, based upon my advice, without consulting an attorney and explaining all the facts to him. You are best advised to seek the services of a competent Kentucky attorney. You can get a referral to a criminal law specialist from the Kentucky Association of Criminal Defense Lawyers, at

Additionally, you can telephone your local bar association for a referral, or can find a good lawyer on-line at the Kentucky Bar Association's Lawyer Referral Service:
