first offense dui violation code 21090

What is the maximum penalty (fine and suspension of license) for first time offense of DUI? I blew .199. Should I have an attorney present with me at court?

Be very careful in this matter. I recommend using an attorney as well. A BA reading of greater than .18 on a first offense DUI if convicted provides for mandatory jail time. It's an "aggravating factor" under the new law which came into effect October 2000. DO NOT go without an attorney. You could wind up doing jail time. Further, DUI is an enhanceable offense. A 2nd, and 3rd conviction within 5 years gives stiffer jail time and license suspensions. Also, a 4th offense within 5 years is a felony! This is nothing to mess with. Call an attorney immediately. i recommend an attorney go with you. the maximum for a first dui is a $500.00 fine or 12 months in jail, plus alcohol assessment and classes and a 90 day suspension of your license. you may be able to lessen or diminish any of the above fines, etc. you can contact me at [email protected] or 502-583-2005.
