Legal Question in Family Law in Kentucky

My ex-wife of 13 years has just served me with papers regarding our 18 year old daughter.She is trying to sue me now for 35,000 dollars for "college money". I had an annuity for our daughter when we first got divorced and in the papers I stated I would continue to have that for her. Well, when the stock marked plumited, so did the annuity. IT was worth nothing. I have paid child support. She is 18 but is "supposively a senior but she has been going to night school once a week. SHe was getting into much trouble in regular day high school. In the papers it said that i am liable for 35000 which is a guarenteed amount that the annuity should be. You cant guarentee an annuity. My question, does she have a ground to stand on. SHe has never allowed me to clain our daughter on taxes. I have always maintained health insurance.
