Garnishing Wages

This question is in refrence to a friend! He is currently seperated from his wife, and she has a truck (which includes both his name and her name on the title, but is in her possession). She hasn't been paying the note on the car and now the car dealership that owns it is currently garnishing his wages(she doesn't work but draws a disability check every month) because of her non payment. What if anything can be done to resolve this issue? And since they are seperated and she has full possesion of the vehicle can he maybe take her to court and get re paid the money that has been garnished from his checks? HELP!!!

Without more information about the situation, it is impossible to give you a clear-cut response. However, based on what you have posted, it appears the truck debt is in both their names. If so, your friend is responsible for payments if his wife does not make the required payments. Just because they are separated does not relieve him of his contractual obligations. Your friend needs to contact an attorney to deal with this issue as quickly as possible.

If attorneys fees are an issue, then he needs to bring that up with the attorney he chooses and most likely an arrangement can be made. There are many attorneys willing to work out alternative fee arrangements. In the long run, it is less expensive to get help on the front end than to incur the costs of cleaning up an even bigger mess later.
