unfit parent (father fears safety)

I have a brother in-law who is unhappy and fears for his two children. The mother has threatened to hurt herself or one of the children. He is a truck driver so what kind of legal standpoint does he have to get custody of his children? There is plenty of family support to help raise the girls.

Assuming that the mother has threatened to harm one of the children and he believes she might do so, he should go to the district court where the children live and file an emergency protection order on behalf of the children. Beyond that, as father he has standing to pursue custody by virtue of being the father.
