Legal Question in Insurance Law in Kentucky

auto accident

Traffic stopped and a car hit my bumper because they were hit from behind as well. The insurance company for the car that hit mine is claiming no responsibility because their client was hit from behind and pushed into my car. I cannot find the insurance company of the third car. Whose insurance is responsible for my damages?

In the ideal world, the insurance for the car that actually made contact with your car should pay for the damages and then seek "subrogation" (reimbursement) from the other insurer. Depending on the amount of damages, you may need to file a claim in small claims court.

If there were police reports filed, the third cars insurance should be on there. If they did not have insurance, you may have uninsured motorist coverage on your policy that you could try to get to pay and then your insurer would pursue subrogation.
