My husband recently passed away. We have a home in both of our names only. Do I retain full property rights or do I have to sell it and split the money between our children?

Depends on what your deed says. If you were married at the time, most likely you have right of survivorship, meaning you assumed full ownership of the property at the time of his death and it will not be probated. Have your probate attorney review the deed to be certain.
