Legal Question in Wills and Trusts in Kentucky

who has rights to non willed death

My grandmother passed away recently without a will. She had one daughter (my mother) and a husband (my step grandfather. Her house is deeded in her name only. Who has rights to her estate? Cash, house, furniture, jewlery etc. Does my mother have any claim to her estate?

Thank You

Under Kentucky intestate law your grandmther's estate will go 1/2 to your mother and 1/2 to your step-grandfather, after payment of all expenses.

Re: who has rights to non willed death

Kentucky recognizes a so-called "dower" right of

a surviving spouse to claim a one-half interest in

both real estate and personal property. Surviving

children (such as your mother) are entitled to

claim the portion of the property (real and

personal) not covered by dower. There may be

some exceptions, depending on variables, but

these are the basics.

My condolences on the loss of your grandmother.
