Legal Question in Wills and Trusts in Kentucky

My mother just died. She had her will and deed in a locked box. She showed it to me....about 7 months ago. While she was ill, my 1 sister went into her home, got the locked box and gave it to my brother.

NOWhe can not find the will or deed in the box..... it was there.

He is a convicted felon. served 18 mo in Big Sandy Min Security Prison for posession of pot and un registered guns..he had to also take credit for a pot field he had been working in for his friend.

He tricked my sisters in to agreeing to him having POA of mom while she was in U.K.

Now he is trying to get Administration of estate. The will stated the me and my next oldest sister are the exectors.

I know he has done something with mom's will and deed.

Help what can we do....Can he legally hold the administrator position with his record....He still takes a lot of pills, because he's in pain.....I don't agree with him taking over. He was so very mean and ruling over us while we were with our mother.

I got a letter on Aug. 23 2008 stating that he was going to court on the 25th to do this. I live in N.H. and I am ill.....I can not get there by the 25th. I have tried to get a lawyer to help me...in London, Ky...

What can I do? ASAP

Based on what you have described, you really need to get an attorney who practices in Kentucky to deal with this. Since yesterday was the 25th, that time has been missed, but you can still intervene in the case and you should do so soon in order to protect your rights. London is not so far that you have to limit your search for attorneys to that town alone - any attorney licensed in in Kentucky can do it.
