Legal Question in Bankruptcy in Louisiana

adding debts after filing?

I have filed ch7 recently and am waiting on my discharge any day now.The problem is that I have just started recieving medical bills related to the ones I listed in the ch7 but are not included in the price. The question is, is there any way to add these bills{they add up to around $1000.00}to the bankruptcy or am I stuck paying them?Thank you for yourtime.

Re: adding debts after filing?

Generally, in a chapter 7 case, debts are determined as of the date a case is filed. Even if you did not have the medical bills (or knowledge of the exact amount owing) when your case was filed, those debts are claims which can be discharged. (I am not sure what you mean by "price" but often claims are estimated.) Additionally, those creditors who were listed in your bankruptcy papers should not be sending you anymore statements as this violates the automatic stay in bankruptcy.

If the creditors were not listed in your bankruptcy papers, you have any opportunity to amend your schedules to list them. Your attorney should be able to assist you with this. If you do not have any attorney, you can call my office at (818) 992-6588 to assist you.

You are however responsible for debts incurred after your case was filed. Those claims would not be discharged.

If you are represented by an attorney you should first and always consult your attorney.

If the medical bills you are now receiving are for medical services obtained before the chapter 7 petition was filed then the petition can be amended to include these debts. If the bills are for services obtained after filing they cannot be included in the petition.
