Legal Question in Criminal Law in Louisiana

I forgot my purse in restaurant which contained $2400. I returned to the store about 10 to 15 minutes later to find my purse gone. I asked the employees if they had seen the purse and they all said no. I called the police to make a report and when he returned he watched the surveillance camera. He told me that he had seen one of the employees walk into the restroom with the purse and when she returned she didn't have it on her. After questioning the employee the police $1400 was retrieved on another employee. What can I do to get the rest of my money back? Can I sue the restaurant? Or can I sue the employee?

Yes, you can sue both the employee and the employer. Before you do, you may want to talk to the District Attorney's office. If the employee was prosecuted for the theft, the Court will likely order the employee to pay restitution, which means the criminal court will make certain that you are repaid, under penalty of incarceration of the thief.

If you have to sue, you can do so in Small Claims Court. Go to either the City Court or the Justice of the Peace with jurisdiction over the area where the crime occurred (the restaurant) and file suit. You can file without a lawyer. It is pretty simple to do.
