Legal Question in Criminal Law in Louisiana

Is a prosecutors subpoena misdated a year old(dated 08 not 09) good for attaining a ISP address in criminal case? Is it a non-substantive error, or is it challengable? And Why?

Dear Law Guru Friend,

In a criminal case anything can be

challenged. Now, whether you win or

not is another matter. I know that

even subpoenaes do have deadlines

attached to them. Ignoring the subpoena

is one thing, challenging it another.

The safer thing to do is to challenge it.

If you want to discuss this further, I shall

be happy to research the law and discuss

this with you--all at nor charge. If

you want to do that, e-mail me your name

and phone number, and I will call you on the

phone and/or e-mail you back to discuss

this further.

Sincerely,

Hardy Parkerson, J.D. - Lake Charles
