Re: Armed roberry

Dear LawGuru Friend,

Sorry about your son! If he was seventeen (17) at the time the offense was committed, then he was not a juvenile. There is a one year period in Louisiana during which a teen ager is neither a juvenile nor an adult, and that is between his seventeenth and eighteenth birthdays. Ten years seems harsh for one so young; but, as you may know, he could have been sentenced to ninety-nine (99) years. If I knew more about the circumstances of the armed robbery, I might understand why the judge gave him ten years, instead of only the mandatory minimumm of five (5) years. You might consider asking the judge to resentence him after he has served some time in prison. There is no way, however, that the judge can give him less than five years, without benefit of probation, parole or suspension of sentende on an armed robbery conviction. Did your son have a trial, or did he plead guilty? I am surprised that since he was so young, the D.A. did not offer at least to reduce the charge to at least simple robbery Please feel free to call me and discuss this! This web-site will not allow us lawyers to post our phone numbers. Obviously, I do not make the rules. Again, feel free to call me and to discuss this matter. There is no charge for just talking. Good luck to both you and your son!

Re: Armed roberry

Dear LawGuru Friend,

For some reason my answer to your question about your son's conviction and sentence for Armed Robbery was filed by this web-site under the heading of D.W.I/D.U.I and such, not under Criminal Law. You might want to look for the answer that was posted there on March 15, 2006, under my name and under the title of Drunk Driving, or whatever it may be call having to do with driving under the influence of intoxicants. Best of luck!

Sincerely,
