Legal Question in Family Law in Louisiana

My ex-husband and I were seperated for over 3 years before our divorce was finalized. My daughter was born 6 months after we were legally divorced. Until he signs an affidavit saying that the child is not his, her father cannot sign the birth certificate. My ex did not want the divorce, so he is trying to get me where it hurts and refuses to sign the affidavit. My boyfriend and I plan to get married, so I want her to have his last name. Is it possible to give her his last name while we are waiting for my ex to agree to sign the affidavit?

You can have the child's name changed but do a paternity test and that will give the authorities the proof they need. You may need to do a petition to establish paternity.
