Wage Garnishment

I would like to know if my ex and I can go to a lawyer and have him draw up some paperwork to have my ex's wages garnished for child support. His company will not garnish his wages unless he has a court order. However, he doesn't want to go back to court. We get along, so is there any way we can hire an attorney to draw up the paperwork to have his wages garnished and file it with the court without having to go to court? Thank you for your time.

Yes, contact a lawyer. It is called a "wage assignment order" and can certainly be written and presented to a judge for signature without anybody going to court.

Your plan is very intelligent. You will save yourselves the cost of litigation. Your ex will never miss a payment and won't have to worry about writing the check. Your child(ren) will always be provided for.

If the support order is more than two years old I would also suggest having the lawyer recalculate the support guidelines because finances do change over time.
